- You are currently living in the United States.
- You are a US citizen or legal resident.
- You are not currently incarcerated.
- Your income is no more than 400% (or 500% in 2021 and 2022) of the FPL.

Off-Exchange major medical health insurance plans are generally not eligible for subsidies. Under Obamacare, people who do not qualify for or want a subsidy, but who want to avoid the tax penalty, can buy major medical health plans that meet ACA coverage standards on or off of government-run state exchanges.
Does Medicare meet Obamacare requirements?
If you have Original Medicare (Part A and Part B), Medicare Part A only, or a Medicare Advantage plan, you meet the Affordable Care Act requirement to have health insurance. However, if you are only enrolled in Medicare Part B, this does not satisfy Obamacare’s minimum essential coverage requirement.
